What Happens When You Fill in a Flood-Affected Property in SEQ?

Filling a flood-affected site might seem like a straightforward solution — raise the ground level, reduce flood risk, get on with the build. But in South East Queensland, it is rarely that simple. Filling within a flood-affected area carries significant planning, legal and engineering consequences that catch many landowners and developers off guard.

This article outlines five things most people do not realise about flood filling in SEQ — and what you should do before a single cubic metre of earth is moved.

1. Filling Can Push Floodwater Onto Neighbouring Properties — and You Can Be Held Liable

One of the most serious and least understood consequences of site filling is its effect on neighbouring properties. When you raise the ground level of your site, you alter the way floodwater moves across the land. Water that would previously have been absorbed or passed across your property may now be redirected — and concentrated — onto adjacent lots.

Under Queensland law, a property owner can be held liable for flood damage caused to a neighbour as a result of unauthorised or poorly designed filling. This is not a theoretical risk. Civil claims arising from altered drainage patterns and redirected floodwater have been pursued through the courts.

Before any filling work is carried out, a qualified civil engineer should assess how the proposed works will affect overland flow paths and neighbouring properties. A hydraulic impact assessment may be required as part of a development application.

2. Filling Within Flood-Affected Areas Will Often Require Council Approval

Many landowners assume that filling is an exempt activity — something they can do without council involvement. In flood-affected areas, this is frequently not the case.

Across SEQ, most planning schemes include flood overlay controls that govern what can and cannot be done within flood-affected land. Filling within these areas will often require a development application (DA) and assessment against the relevant flood overlay code.

The specific requirements depend on the applicable planning scheme, the nature and extent of the flood overlay, and the location and volume of the proposed fill. Councils assess these applications carefully — and may impose conditions or refuse approval where the filling creates unacceptable flood impacts.

Carrying out filling without the required approvals exposes landowners to enforcement action, including mandatory removal of the fill at their own expense.

3. Filling Can Block Natural Overland Flow Paths — Triggering a DA You Didn’t Expect

Overland flow paths are the routes that stormwater and floodwater naturally follow across land during and after significant rainfall events. They are not always visible — many run through private properties without any physical indication on the surface.

If proposed filling obstructs or redirects an overland flow path, it can trigger a development assessment requirement that the landowner had not anticipated. Even filling intended for a minor landscaping purpose can cross this threshold if it affects an identified flow path.

A pre-application consultation with council and a desktop hydraulic assessment are strongly recommended before any filling work is undertaken on flood-affected or flood-adjacent land.

4. Filling Does Not Remove Flood Overlay Constraints

A common misconception is that if you raise the ground level of a site above the defined flood level, the flood overlay no longer applies. This is not correct.

The flood overlay is mapped against the site — not the ground level. Even after filling, the site may still be assessed as flood affected under council planning controls. Future development on the site will continue to be assessed against the flood overlay code, including requirements for minimum floor levels, building materials and construction methods appropriate to flood conditions.

The overlay can only be formally reviewed through a specific planning scheme amendment process — filling alone does not achieve this outcome.

5. Trying to ‘Keep Water Out’ Can Cause Structural Collapse

When flood depths exceed approximately 500mm, the hydrostatic pressure exerted by floodwater on the outside of a structure becomes significant. If a building is sealed or designed to prevent water entry, this pressure differential can cause serious structural damage — including wall failure and foundation collapse.

This is why flood-resilient design in Australia generally follows a flood-compatible approach: allowing water to enter the structure to equalise pressure, rather than attempting to exclude it entirely. Any engineer or builder advising a ‘keep water out’ strategy for deep flood conditions should be approached with considerable caution.

Understanding the specific flood depths applicable to your site is essential before any design decisions are made.

What Should You Do Before Filling a Flood-Affected Site in SEQ?

The risks outlined above are manageable — but only if they are understood and addressed before work begins. The following steps are recommended for any landowner or developer considering filling on a flood-affected or flood-adjacent site in SEQ:

  • Review the applicable planning scheme and flood overlay controls for the site
  • Commission a hydraulic impact assessment from a qualified civil engineer
  • Seek pre-application advice from the relevant council before lodging a DA
  • Confirm whether the proposed fill affects any mapped overland flow paths
  • Understand the flood depth and velocity characteristics of the site before designing any structures
